Below please find information on the processing of your personal data in our company, ipso facto in conformity with the obligation referred to in Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (referred to as the “GDPR” or “General Data Protection Regulation”).

Depending on the type of contacts and cooperation with you, concluded agreements, binding on us both currently and in the past, our organization holds data constituting your personal data i.e.: address of the registered office or residence, address for correspondence, email address, phone number, first name and last name, numbers from registers (NIP [Tax ID No], REGON [National Business Register] No, KRS [National Court Register] No, PESEL [Personal Number]).

This data has been acquired by us from generally accessible Internet search engines or has been provided to us by you in person or in email correspondence, via Poczta Polska or by phone.

Performance of agreements binding on us, maintenance of contact with you, sending of information about our services as well as fulfilment of legal obligations by us e.g. when the law requires that your data be processed by us for tax and accounting purposes – Tax Code Act and Accounting Acts are the objectives of processing your data.

We also process your data to perfect our offer, ensure the best quality of our goods and services, inform our customers about them and conduct direct marketing.

Your data may also be processed for the purpose of securing or seeking claims as well as for the purpose of accounting for fulfilment of legal obligations by us.

The data is processed by us based on:

  • Article 6 (1) (a) of the Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “Regulation”) i.e. based on your consent if given to us by you, in situations when such a consent has been required,
  • Article 6 (1) (b) of the Regulation to perform agreements or to take actions prior to conclusion of an agreement,
  • Article 6 (1) (c) of the Regulation to fulfil legal obligations imposed on us,
  • Article 6 (1) (f) of the Regulation when our legitimate interest is the basis for the processing to perfect our offer, ensure the best possible quality of our goods and services, inform our customers about them, conduct direct marketing, secure or seek claims, account for fulfilment of legal obligations by us.

You provide us with the personal data on a voluntary basis, however it may turn out that without providing the data we will be unable to perform or prepare an agreement. Provision of such data as phone number or email address is voluntary as well, however in case of failure to provide it, we will not be able to contact via these channels.

If we have asked you for the consent to the processing of the personal data, this consent may be withdrawn at all times, without affecting conformity with the law on the processing carried out based on the consent prior to its withdrawal. Period for which the personal data will be stored

The personal data processed to conclude or perform the agreement and fulfil the legal obligation imposed on the Controller shall be stored for the term of the agreement and, after its expiry, for the period necessary to secure or seek claims and fulfil the Controller’s legal obligation e.g. arising out of tax law provisions and accounting law provisions.

The personal data processed based on the Controller’s legitimate interest shall be stored for the time of existence of this interest or by the time of lodging an objection by the data subject.

The personal data processed based on the consent shall be stored by the time of its cancellation.

Sharing of the data

We do not make your data accessible to third parties if we have no legal basis for this.

In view of the processing, your personal data may be made accessible or entrusted to the following entities:

  • authorized staff members of the Controller,
  • entities rendering outsourcing, accounting, IT services and maintaining IT infrastructure for the Controller,
  • public bodies based on statutory requirements.

You have the following rights:

  • right to access data (Article 15 of the GDPR)
  • right to demand rectification of data (Article 16 of the GDPR) if untrue or incomplete
  • right to demand erasure of data (Article 17 of the GDPR) if the data is not processed in compliance with the law, the consent to process the data is withdrawn or the data is no longer necessary for the purposes for which it has been collected, an objection has been lodged towards the processing of the data, the data must be removed to fulfil the legal obligation
  • right not to be subject to automated decision-making, including profiling
  • right to demand limitation of data processing (Article 18 of the GDPR)
  • right to data portability (Article 20 of the GDPR) if the processing takes place based on the consent or agreement
  • right to withdraw the consent to personal data processing
  • right to object to personal data processing if the processing of the personal data takes place based on the legitimate interest or for statistical purposes and the objection is justified by
    a special situation of the data subject or if the data is processed for the needs of direct marketing
  • right to lodge a complaint in view of data processing with the President of the Personal Data Protection Office.
